Terms of Service

By placing an order, you agree to the following Terms of Service. Failure to read these terms does not exempt you from them.

1. General

All services provided by Miracle Development Studio are digital products or digital services. Orders are handled exclusively via tickets to ensure clarity and proper tracking. By opening a ticket with an order, you confirm agreement to these terms.

2. Orders and Scope

The project scope is defined and agreed upon before development starts. Any changes or additions requested after scope is agreed may require additional payment or extended timelines. Miracle Development Studio reserves the right to decline unrealistic or abusive requests without obligation to explain further.

3. Payments

Accepted payment methods:

• PayPal Friends & Family (balance only)
• Cryptocurrency: LTC, USDT, SOL, BTC

Payments must be completed before development begins, unless a milestone or deposit arrangement has been explicitly agreed upon in writing. Partial payments or milestone structures are only accepted if agreed beforehand.

4. Payment Terms (Strict)

• No refunds once development has started.
• Failure to follow these terms results in rejection of the order and no refund of any deposit.
• Third-party payments are not accepted. Payment must come directly from the client.
• Do not include notes, references, or identifiable information in payment unless explicitly instructed.
• All transaction fees (PayPal fees, cryptocurrency gas fees, and any applicable network fees) are the sole responsibility of the client.

5. Delivery Timeframes

Delivery times provided are estimates, not guarantees. Delays may occur due to scope complexity, third-party API limitations, platform outages, or real-life circumstances. Clients will be informed promptly if a significant delay is anticipated. Miracle Development Studio will not be held liable for losses arising from delivery delays outside our reasonable control.

6. Fixes and Support

Each order includes up to 3 bug fixes for issues within the originally agreed scope. Bug fixes do not cover new features, redesigns, or changes to requirements. Post-delivery support and ongoing updates are handled on a case-by-case basis and may be subject to additional fees. Setup assistance and usage guidance are provided as needed within reason.

7. Source Code and Ownership

By default, clients receive full source code upon completion of final payment. Exceptions apply only where explicitly agreed in writing before the project begins. Rebranding and reselling of delivered work are permitted under an additional licensing fee agreed upon beforehand. Representing the delivered work as your own original creation without permission is not permitted.

8. Compatibility and Updates

Miracle Development Studio aims to build projects compatible with relevant platform standards at the time of delivery (for example, the Discord API or Telegram Bot API). Ongoing compatibility updates following platform changes are not guaranteed unless explicitly included in the project scope or a separate maintenance agreement.

9. Client Responsibility

Clients must provide clear, accurate, and complete requirements. Miracle Development Studio is not responsible for:

• Misuse, abuse, or unlawful use of delivered products
• Failures or changes introduced by third-party platforms or APIs
• Issues arising from client-side configuration, hosting, or deployment errors
• Any consequences resulting from inaccurate or incomplete briefs

10. Confidentiality

Both parties agree to keep confidential any non-public information exchanged during an engagement, including project details, source code, credentials, pricing, and the contents of private communications. Neither party will disclose this information to third parties without the other’s consent, except where disclosure is required by law.

Miracle Development Studio may reference completed work in its portfolio only with the client’s prior consent. This confidentiality obligation survives the completion or termination of the engagement.

11. Force Majeure

Neither party will be liable for delays or failures in performance caused by circumstances beyond its reasonable control. This includes, without limitation, platform outages, third-party API failures, internet infrastructure or hosting disruptions, power failures, natural events, and changes in law or regulation. Affected obligations are suspended for the duration of the event, and timelines are extended accordingly.

12. Communication

The primary channel for all project communication is the relevant Discord ticket. We aim to respond within 48 hours on business days. During active development, the client must remain reachable so that questions and reviews do not stall the work.

If a client is unresponsive for 7 or more days without prior notice, Miracle Development Studio may pause the project until contact is re-established. Timelines are extended by the length of any such pause.

13. Termination

Miracle Development Studio reserves the right to refuse or cancel any service at any time for valid reasons, including but not limited to: abuse of staff, violation of these terms, suspected fraud, or suspicious behaviour. In the event of termination initiated by Miracle Development Studio without client fault, any unearned portion of payment will be refunded.

14. Governing Law

These Terms of Service are governed by applicable European Union law. Any disputes that cannot be resolved through good-faith negotiation will be referred to the appropriate legal authorities.

15. Agreement

By placing an order with Miracle Development Studio, you confirm that you:

• Have read and fully understood these Terms of Service
• Agree to all conditions stated above
• Accept the payment terms, no-refund policy, and chargeback policy in full

16. Third-Party Tools and Open-Source Licenses

Delivered projects may include open-source libraries, frameworks, and third-party tools. These remain the property of their respective authors and are provided under their own licenses (for example, MIT, Apache 2.0, or GPL). The client is responsible for complying with those licenses when using, modifying, or redistributing the delivered work. Miracle Development Studio makes no warranty regarding third-party components beyond integrating them in good faith and in line with their intended use.

17. Warranty and Acceptance

Work is delivered on an “as is” basis once it meets the agreed scope. The bug-fix coverage described in section 6 is the studio’s sole warranty obligation. We make no guarantee that delivered software will be free of all defects or fit for any purpose beyond the agreed brief.

18. Limitation of Liability

To the fullest extent permitted by law, Miracle Development Studio’s total liability for any claim arising from an engagement is limited to the amount paid by the client for the specific deliverable in question. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.

19. Changes to These Terms

We may update these Terms of Service from time to time. The terms that apply to your engagement are those in effect on the date your order is placed. The “last updated” date above always reflects the current version.
